John Fagan named National Ski Areas Association special counsel

The National Ski Areas Association has appointed Duane Morris partner John Fagan to the position of special council.

Fagan is the third attorney to be appointed to the position in the NSAA’s more than 40-year history.

As special counsel, Fagan will advise the organization on a broad array of legal issues and trends. In particular, he will provide counsel on risk management and legislative issues and assist in the preparation of amicus curiae briefs in litigation of interest to the NSAA and its membership. In addition, Fagan will act as a liaison between the NSAA and the Association of Ski Defense Attorneys, a group of lawyers regularly retained to defend ski areas in the United States and Canada.

“John is recognized by his peers as one of the industry’s preeminent attorneys through his many notable achievements in representing ski areas both large and small,” said Michael Berry, president of the NSAA. “We’re confident that our national association, and the industry as a whole, will benefit greatly from his commitment and legal expertise.”

Fagan is a member of the American Board of Trial Advocates, the Association of Ski Defense Attorneys, the American Society for Testing and Materials and the Defense Research Institute. Fagan also works closely with and is regularly engaged to speak before the California Ski Industry Association and the Water Sports Industry Association. He has published many articles on sports and recreation liability issues.

Fagan is a 1982 graduate of the University of Michigan Law School and a graduate of the University of Michigan.
