Kahle designer sues county

Resource Concepts, Inc., contracted by Douglas County to construct parts of Kahle Park’s original design, filed suit against the county June 15.

The lawsuit alleges the county shortchanged RCI for about $142,000 for work the engineering and land surveying firm did in the early 1990s while constructing Phase 1 of Kahle Park.

Although there is no court date scheduled, the case will be heard in Douglas County District Court Department 2 before Judge Michael Gibbons.

The lawsuit revolves around such issues as construction change orders filed with the county by RCI and whether RCI received prior approval to request the increased fees in the change orders.

Douglas County was also dissatisfied with some of the work performed by RCI, according to a letter from the Douglas District Attorney’s office to RCI’s counsel.

The county has until late July to respond to the lawsuit. Soon thereafter, RCI attorneys suspect there will be a conference with attorneys for both sides in an effort to find a settlement.

Should the case go to trial, it likely won’t be resolved until 1999.
