South Shore men released; Rape investigation continues for police

Two South Shore men accused of raping a 25-year-old woman early Wednesday morning have been released pending further investigation.

Jose Sandoval, 28, and Rafael Flores Garcia, 29, were arrested Wednesday when a woman reported that the two men had raped her in an apartment on Spruce Avenue in South Lake Tahoe.

Assistant District Attorney Hans Ucuthe said the men were released Monday because of a lack of evidence.



“There’s some forensics work that will probably take a couple of weeks to get the results,” Ucuthe said. “We’ll complete the investigation and make a decision in terms of what to do about the case.”

According to police, the woman and Sandoval’s girlfriend had come back to the apartment after going to a Stateline night club. Police said the woman had fallen asleep on the sofa and was helped by her friend into a spare bedroom, where she was left fully clothed and covered with a blanket.




The woman reported that she woke up with Sandoval on top of her. She was then allegedly raped by Garcia, police said.

Sandoval is also being charged with battery for allegedly grabbing his girlfriend by the face and pouring beer over her head during an argument that took place earlier in the night, police said.

Ucuthe added that the battery charge will be taken up when the investigation is concluded, which could take more than a month to complete.
